The following terms and conditions do not affect your statutory rights

Ownership
All goods remain the property of The Plant Directory until paid for in full. If your payment fails or becomes void we will require an alternative method of payment before the title transfers to the purchaser. Once paid for the item becomes the responsibility of the purchaser and we cannot be held responsible for any consequential events

Vat
All prices shown include Vat, where applicable at the standard rate with the exception of plants from some concessions such as specialist growers which may be zero rated. Our parent company is Scawsby Hall Nurseries and the Vat registration number is 789 4792 46. We trade by mail order and online as The Plant Directory

Availability
All items are subject to availability. We try to keep the online store stock number updated regularly but there are occasions when our actual physical stock and online numbers do not match, however your card is only authorised at the checkout and not debited until we know we can supply the items you have ordered. If there is an unexpected delay we will contact you to advise of this, and if you do not wish to wait for the item to come into stock you can cancel your order. To check current availability you can email us or call 01302 783434 between 10am and 5pm, 7 days per week. Free items are promotions only available to on-line store customers. These items are subject to availability and limited to one per customer and one per address. Our normal delivery charges apply to free items


Price changes and payment
All prices, including any charges for packing and delivery, are subject to change without notice. However, we will advise you of any increase before despatch and you will have the option of cancelling the order. If you place an order by phone we will advise an approximate delivery time and if this is acceptable we will debit your card immediately. If you order online we will normally not debit your card until despatch of your order is imminent. Where we have to order larger goods from a third party e.g. some large garden furniture we will normally debit your card at the time we receive the order to ensure there is no problem with the payment information provided


Substitutes
We will not send substitute items if the ones you order are not available without contacting you first

Failure to deliver on expected day

We will email all customers who provide us an email address when the order is dispatched and give the expected delivery day however we accept no responsibilty whatsoever for either Royal Mail or the courier company not delivering on a specified day, as this is out of our control. A signature is not always needed so goods can be left in a safe place at your risk, such as with a neighbour or in the back garden, so you do not need to be at home when the order is delivered. Please ask for this when you go through the Checkout pages

Shortages, Damaged or Defective items

You must inform us within 7 days in writing or by email of any shortages, or if any part of your order is incorrect, damaged or defective. Please keep the item/s and the packaging.  Click on this link to for our Contact Us page. Incorrect, damaged or defective items will be replaced as soon as possible

Cancellation
You may cancel your order at anytime up to despatch without penalty, once goods have been despatched we will be charged by the courier and reserve the right to retain any shipping charge paid, or a re-stocking fee of 10% on orders which include delivery

Unwanted/Incorrect/Faulty/Damaged items
All purchases are covered by our 28 day Satisfaction Guarantee and if you decide not to keep an item you can return it to us at our Doncaster address and obtain a full refund of the purchase price (customer to arrange the return or we can have it collected for you and can deduct the return cost from the refund amount). Please read our Refund and Returns policy first

Disclaimer & Liability
Please note that named species and cultivars are described and supplied in good faith. However, if you find that the plants supplied are not of the type you ordered please contact us to arrange a replacement or refund. Any liability due to our inabilty to supply, late delivery or the delivery of an incorrect item is limited to the value of the order and excludes any consequential loss. We reserve the right to change or discontinue any promotions and offers without notice. If you place an order linked to a promotion or offer which we have subsequently changed or withdrawn you can cancel the order without financial penalty

Completion and Consequential Loss
We cannot be held responsible for any upset or consequential losses which occur as a result of making a purchase in our online store, incorrect labelling or by us not being able to supply any items. We also reserve the right to refuse any order without the need to provide a reason



Non-Plant Guarantees
Electrical items and some others carry a manufacturer's guarantee. In the event of a claim being necessary contact us for advice as some items can be returned to ourselves while others have to be sent back to the manufacturer. Where an item is covered by a manufacturers guarantee, please retain your packaging & invoice for the period of the guarantee

Paying by Paypal - non return of transaction fee
In exceptional circumstances we may agree to providing a refund beyond our 28 Day Satisfaction Guarantee Period. If you have paid by Paypal, and the transaction was older than 60 days we will refund the total amount less the transaction fee we have paid to Paypal, this is equivalent to £3 in every £100 spent. This is because unlike credit and debit card issuers, Paypal will not refund our transaction fee if the transaction is older than 60 days

Acceptance
Placing an order indicates your acceptance of these terms and conditions
